Spam legislation affects even the good ones using Email. The importance of the changes all permission Email marketers need to do can
not be underemphasized. They are basic but essential.
An overview of the Bill:
The main points of the CAN-SPAM bill:
- Preempts all 36 state antispam laws specific to electronic mail (Including the recently passed agressive California State Law)
- Unsolicited Commercial Email must include an opt-out option
- Prohibits false and deceptive headers and subject lines
- Provides for additional criminal provisions and monetary damages for the worst violators
- Requires the FTC to report to Congress with a plan to implement a "do-not-spam" list
- Prompt removal of all opt-outs.
- Physical postal address in all messages
- "Clear and conspicuous" notice for all messages that are ads

AUSTRALIA PASSES ANTI-SPAM BILL
Australia's parliament approved legislation recently that bans unsolicited
commercial Email outright in most cases. Unlike the CAN-SPAM Act of 2003,
which is nearing approval in the United States, Australia's Spam Bill 2003
requires customer consent before a commercial message may be sent.
President Bush signed the CAN-SPAM Act of 2003 into law 12/16/03.The federal
law, passed overwhelmingly in Congress this month, takes effect Jan.
1, creating a single national standard to regulate commercial Email
in place of the patchwork of laws in more than 35 states.
